AFFIDAVIT OF CUSTOMER
GENERAL FIREARM SALES ONLINE
All firearms, magazines, receivers and restricted law enforcement items are sold and shipped in accordance with all existing federal, state and local laws and regulations. Many of the firearms, magazines and parts for sale on this website may be restricted or prohibited in your area. Please check your local and state regulations before ordering.
It is illegal to ship firearms to anyone not holding an active Federal Firearms License (FFL). For that reason, firearms purchased online may picked up at our store or shipped to an FFL (gun store) near you. We will contact and verify the FFL you select during checkout before we ship your firearm(s).
All new firearms are shipped in the original manufacturer's box, with magazine(s), accessories and applicable warranty. Firearms requiring warranty work must be returned to the factory within 1 year of purchase for repair. Accessories and special order items not normally sold by our store will not be covered under warranty even if these products are part of an integrated firearms package, unless we have guaranteed the entire package in writing. Please contact the original manufacturer for warranty information on all accessories and special order items.
PROHIBITED SHIPPING ADDRESSES
I will not request that Eisen Arms, LLC ship packages outside the lower forty-eight states of the United States or to Massachusetts, Chicago, New York City, or any other area that is prohibited by federal, state, or local law (Eisen Arms, LLC does ship to Illinois, New Jersey, and Connecticut where proper documentation is provided).
ORDER FULFILLMENT
All orders are shipped promptly from our warehouse or in-store inventory using UPS, FedEx, or USPS. Tracking numbers are available for items shipped via UPS and FedEx.
ONLINE PRICE & DESCRIPTION ERRORS
Our online inventory changes every day. Occasionally an item may appear on the site by mistake or the item's description may contain a typographical error. We do not guarantee that titles, descriptions, pictures or prices on our site are error-free. We reserve the right to refuse any order including but not limited to orders for items with errors in the description or price. In the event that we cancel an order we will not charge the customer's credit card or we will refund the money.
ORDER CANCELLATIONS
I understand that Eisen Arms, LLC order system automatically submits my order to the distrubutors for picking/shipping and that I cannot cancel an order once placed (seriously, our system sends your order to the distrubitors within less than five minutes of being placed). I also understand that Eisen Arms, LLC may cancel my order at any time if I have not abided by the Terms of Sale at which time a refund will be provided.
I understand that if I refuse to accept delivery of an order that I placed, then Eisen Arms, LLC will charge me the full cost of shipping plus a restocking fee equal to 25% of the value of my order. In this instance, the "full cost of shipping" is the cost to ship from the distributor's location to my house, plus the cost to ship back to the Eisen Arms, LLC (which is the same amount of the initial shipment to my house). I will receive back the remainder of my original payment (minus shipping and restocking amounts, as explained above) as a store credit, not as a refund.
RETURN POLICY - NON FIREARMS
I understand that Eisen Arms, LLC does accept returns for defective or damaged product (excluding firearms) where customers notify them of such issues within TEN (10) days of their order date. If there is anything wrong with my product, Eisen Arms, LLC wants to make things right. Eisen Arms, LLC just asks that I tell them about any issues quickly, within 10 days of my order date, so that they can service me promptly. I am to email the Eisen Arms, LLC team at EisenArmsLLC@Live.com if I desire to discuss a return. Finally, I understand that Eisen Arms, LLC may, at its sole option, choose to reimburse me by either a refund, a store credit, or a replacement of the product.
Sales on the following items are final:
Special orders.
Products sold "as is" or "used" or that have been installed or used after receipt.
NFA items.
Illumination devices, electronic sights and optics.
RETURN POLICY - FIREARMS
I understand that Eisen Arms, LLC does not accept returns of firearms - ALL WARRANTIES, IF ANY, ARE DIRECTLY WITH MANUFACTURERS/DISTRIBUTORS. Firearms should be inspected at time of pickup before excepting delivery.
SHIPPING LIABILITY
I understand that once my package is entrusted to a common carrier (i.e. UPS and FedEx) that Eisen Arms, LLC does not have control over my package. Additionally, I agree that once such common carrier delivers my package to the address I specified, I am fully responsible for that package.
INDEMNIFICATION AND AGREEMENT TO DEFEND
I fully agree that if any of my representations when making purchases under the Terms of Sale are incorrect or if I fail to comply with these Terms of Sale, then I will indemnify, defend, save harmless, and release Eisen Arms, LLC and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from my purchase from Eisen Arms, LLC.
I fully agree that by placing my order, I release Eisen Arms, LLC from any and all liability arising from or related to the products I purchased from Eisen Arms, LLC, including (but not limited to) my or anyone else’s use of the product, my or anyone else’s storage of the product, and my or anyone else’s handling or transportation of the product, and I agree to indemnify, defend, save harmless, and release Eisen Arms, LLC and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from the products I purchased from Eisen Arms, LLC.
CLASS ACTIONN WAIVER
I expressly agree that any dispute resolution proceedings, including but not limited to, litigation, arbitration, and mediation, will be conducted only on an individual basis and not in a class, consolidated, or representative action. By making this express agreement, I acknowledge and affirm that this is a knowing, voluntary, and permanent waiver of any right to bring federal, state, or local claims as any part of, or on behalf of, any class or any other individuals, before a court or other tribunal.
USED FIREARMS
Used firearms may not be returned. All sales are final. Description and photos (if available) are provided by the seller.
SECURE TRANSMISSION
All information collected during the checkout process is transmitted via industry standard Secure Sockets Layer (SSL). A Secure Sockets Layer (SSL) Certificate creates an encrypted link between a Web site and a visitor's Web browser. This link ensures that all data passed between the Web site and the browser remains private and secure.
AMMUNITION PURCHASES
You must be 18 or older to purchase rifle or shotgun ammunition and 21 or older to purchase handgun ammunition. All ammunition will be shipped ground with adult signature required. Always make sure to use the correct ammunition for your specific firearms. Check your local laws for any other regulations.
PRIVACY POLICY
This Privacy Policy governs the manner in which Eisen Arms, LLC collects, uses, maintains and discloses information collected from users (each, a “User”) of EisenArms.com (site). This privacy policy applies to the Site and all products and services offered by Eisen Arms, LLC.
Eisen Arms, LLC may collect and use Users personal information for the following purposes:
- To improve customer service - Information you provide helps us respond to your customer service requests and support needs more efficiently.
- To improve our Site - We may use feedback you provide to improve our products and services.
